The British actress has obtained agreement from defendant Warren Richardson to not use the nude pictures he snapped without her consent on the closed set of "Hippie Hippie Shake."
Victory now belongs to actress
Sienna Miller as the British beauty has finally won her High Court battle against the photographer taking nude photos of her on the set of her new film.
Defendant Warren Richardson from Xposure has given his agreement to not use the pictures and already been ordered to pay the cost of the hearing within four months while may have to pay damages to the star, which are to be assessed at a later date.
Miller previously received a total of $84,500 damages as well as an undertaking not to use the pictures again from News Group Newspapers and Xposure Photo Agency.
The 26-year-old filed a lawsuit seeking default judgment and a permanent injunction against Richardson after he took her pictures while filming "
Hippie Hippie Shake" on a private estate in Surrey, England.
The images, which captured the "
Factory Girl" star removing her clothes and going skinny dipping in a lake, were shot using a long lens without her consent by Richardson and provided to Xposure.
Miller, according to her counsel David Sherbone, was "extremely distressed" by the incident on the closed set location.
"Her distress was further aggravated, not only by the flagrant disregard of her rights, but the context in which the photos were taken - the constant climate of harassment and intrusiveness which she has had to suffer, particularly from the paparazzi in frightening and relentless attempts to get photos of her, exceeding what could possibly be expected to be tolerated, even given her high profile as an actress," Sherbone explained.
In other news about her, Miller has blasted speculations she is to blame for
Sean Penn's marriage split from wife Robin Wright Penn upon being found sitting on the actor's lap with her arm around his neck, branding the publications "outrageously untrue" and insisting they are just friends.
"Sienna is a very good friend of Robin," a spokesman for the actress said. "She adores and respects Robin."
